One of the biggest challenges that family defenders face is strategizing how to handle an abuse or neglect case, without causing negative consequences in criminal court. This training will discuss the importance of having a tailored early plan to lessen negative consequences in concurrent family and criminal court matters. Among other topics to be addressed are arguments to make so that the Judge does not take a negative inference if your client does not testify; ways to get your client’s testimony in at an FCA 1028 hearing through other witnesses; and helping your client make an informed decision for when they should testify even if there is an open criminal matter.
