Identifying Issues That Must Be Raised In 440 Motions

This CLE will train appellate lawyers in identifying “red flags” for further investigation of claims that must be raised in a CPL 440 motion. These claims include ineffective assistance of counsel, Brady issues, and sentencing issues. Lawyers will learn what to look for in the appellate record, questions to ask their clients prior to review of the record, as well as guidance in preparing and litigating CPL 440.10 motions and 440.20 motions.
